Terms and conditions

1. About us and what we provide
Buying Together (buyingtogether.co.uk) is a trading name of Nanoswift Ltd, registered in England and Wales, company number 16216561, registered office 27 Old Gloucester Street, London, WC1N 3AX. By buying from us you agree to these terms.
We provide a declaration of trust template that you complete yourself. You choose every option and enter every detail, and the template fills them into standard wording. We do not draft, tailor or check your document, and we do not give legal advice. We are not a law firm and are not regulated by the Solicitors Regulation Authority.
The template is for two people in England or Wales who are buying, or already own, a home together and are both named on the title. It is not suitable if any of the situations listed under "When to see a solicitor instead" on our home page apply to you. If you are unsure whether it suits your circumstances, take independent legal advice before you sign it.
2. Price and payment
The declaration of trust costs £59, including VAT where it applies. You pay once, by card through Stripe, before you download it. The price shown on the form when you pay is the price you are charged.
Printed copies are an optional extra for £12.99: 2 copies sent by Royal Mail 1st Class to the property address, or, if you're still buying, to a UK address you give us. We send printed orders to the printer the same or next working day, and delivery is then up to Royal Mail.
3. Your right to cancel and refunds
Your declaration is digital content made from the details you enter, and it is ready to download as soon as you pay. Before paying you tick a box asking for it straight away and confirming you understand that you lose your 14-day right to cancel once it's ready to download. We record that consent with the date and time. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, this means the 14-day right to cancel does not apply once your declaration is available to download.
Printed copies are made to order with your details, so they cannot be cancelled or returned once ordered. This does not affect your rights if they arrive damaged or not as described.
If something is wrong with your declaration because of a fault on our side, rather than a detail you entered, tell us and we'll fix it free of charge or refund you. Your statutory rights under the Consumer Rights Act 2015 are not affected.
4. What you are responsible for
- Checking every name, address, amount and choice is correct before you pay. The live preview shows how your details will appear.
- Making sure your co-owner has agreed to what the declaration says. It only works if you both sign it.
- Signing it properly as a deed: each owner in front of an independent adult witness, as the signing guide explains.
- Checking that the Land Registry title shows the restriction the signing guide describes, and applying for it yourself if it doesn't.
- Keeping the signed original safe.
- Deciding whether you need legal or tax advice. For example, a later buyout can mean Stamp Duty Land Tax to pay.
5. Our responsibility to you
We will provide the template with reasonable care and skill, and it will match the preview and the options you chose. We can't promise that it suits your particular circumstances, how a court would treat it in a dispute, or that a lender, conveyancer or other organisation will accept it.
We are not responsible for losses that were not foreseeable when you bought from us, or for losses that come from details you entered wrongly, from the declaration not being signed or witnessed properly, or from using it in a situation it isn't designed for. If we are responsible for a loss, our total liability is limited to the amount you paid us. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
6. Using your document
You can print, copy and use your completed declaration as often as you need for your property. You may not resell or republish our template wording, and our website, software and design remain ours.
7. Complaints
If you're unhappy with anything, email buyingtogether@nanoswift.co.uk and we'll aim to reply within five working days.
8. Changes to these terms
We may update these terms. The version on this page when you pay is the one that applies to your purchase.
9. Law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you can also bring proceedings in your local courts.
